MFA sends letter to CFTC on reduction of duplicative regulation

MFA strongly supports the Commission’s proposal to restore a commodity pool operator (CPO) registration exemption for SEC-registered investment advisers (RIAs) operating pools offered to “qualified eligible persons” (QEPs) and certain other sophisticated investors.

MFA explains:

  • The Proposal is an important and welcome step in the Commission’s efforts to eliminate unnecessary and duplicative regulation while maintaining appropriate protections for investors.
  • QEPs possess the resources and expertise to evaluate investment risks, and exempting qualifying CPOs, including those already regulated by the SEC as RIAs, will reduce overlapping regulatory requirements.
  • Eliminating duplicative requirements can reduce costs ultimately borne by investors while providing sophisticated investors greater flexibility to invest.
